This document governs the technical and ethical framework between Markeno and the user. By accessing our gaming applications or studio services, you agree to the architectural constraints and operational standards defined herein.

01. Service Scope & Provision

Markeno provides sophisticated gaming applications and related software-as-a-service. While we strive for absolute uptime, performance may fluctuate based on local hardware synergy, network congestion (5G vs Wi-Fi 6 latency variations), and regional node distribution.

  • 01.1 We reserve the right to modify application mechanics to ensure competitive balance and thermal stability on mobile devices.
  • 01.2 Access to beta-access tiers is subject to additional stress-testing constraints and local regulatory compliance in Italy.

02. User Conduct & Integrity

Integrity is non-negotiable. Users are prohibited from reverse-engineering binaries, side-loading unauthorized builds for malicious stress testing, or circumventing regional restrictions established for GDPR compliance.

Account Security

Responsibility for maintaining credentials lies solely with the user; unauthorized access must be reported within 24 hours.

We prioritize device longevity. At sustained performance levels, Markeno apps may trigger thermal throttling on older hardware to prevent component degradation. High-fidelity rendering is a trade-off against battery life.

While our primary language is English, we adhere strictly to Italian consumer protections. In cases of discrepancy between translations, the technical architecture of the agreement remains the primary reference point.

Network Variance

Zero-latency input is our target, not a guarantee. Packet loss due to ISP routing or local interference is outside the scope of our liability framework. We recommend Wi-Fi 6 for competitive play.

Common Protocol Failures

01. Identity Shadowing

Failure: Sharing beta credentials with third parties.

Result: Immediate account suspension and revocation of all software licenses. We track session tokens back to hardware IDs (IDFA/IMEI).

02. Latency Gapping

Failure: Attempting to play on unsupported legacy OS versions.

Result: Severe UI fragmentation and loss of session data. We do not compensate for progress lost on unsupported environments.

Proprietary Assets &
Digital Ownership

All visuals, codebases, audio assets, and UI architectures are the exclusive property of Markeno. We grant a limited, non-exclusive license to use these applications for personal entertainment within the constraints of this document.

Feedback Harvesting

Any technical feedback or bug reports submitted become the property of Markeno to facilitate software evolution.

Asset Integrity

Users may not capture high-resolution game assets for the purpose of creating competing products or derivative software.

Hardware Throttling Response

If a user experiences a frame-drop during a peak-intensity sequence on an unoptimized device, Markeno is not liable for competitive losses or tournament outcomes. Our engineering focuses on iOS 14+ and high-dynamic range (HDR) display standards.

In-App Transaction Transparency

All digital transactions are governed by the respective store policies (Apple/Google) and Italian regulatory compliance for digital goods. Refunds for 'consumed' digital currency are not technically feasible under current ledger protocols.
